RE: The tariff classification of gate valve assemblies and gate valve bodies from India, France and Singapore.

Dear Mr. Mento:

In your letter dated August 17, 2006 you requested a tariff classification ruling on behalf of your client FMC Technologies.

The articles in question are described as gate valve assemblies, part numbers P176378, P1000007641 and P1000008039, and gate valve bodies, part numbers 90-131-006, 90-122-659, 90-131-027 and 90-122-614. Descriptive information was submitted.

Based on the information provided the gate valve assemblies are essentially complete hand-operated, steel gate valves packaged in disassembled condition for ease of transportation and installation. Each gate valve assembly includes the valve bonnet, body, stem, hand-wheel, fasteners and other components needed to assemble a complete valve. The gate valve bodies are simply steel valve bodies presented without any other components.

The applicable subheading for the gate valve assemblies will be 8481.80.3055, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other taps, cocks, valves and similar appliances of the gate type, hand operated, of steel. The rate of duty will be 5.6 percent ad valorem.

The applicable subheading for the gate valve bodies will be 8481.90.9060, HTSUS, which provides for other valve bodies. The rate of duty is free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
